Where Injuries Happen in San Diego
The freeways named in San Diego’s own Mobility Element — the I-5, I-15 and I-805 running north to south, and the 52, 54, 56, 94, 125, 163, 905 and 11 connecting across the county — carry a mix the city is unusual for: commuter traffic, military traffic, tourism, and cross-border freight heading for the 905 and the 11.
Two things follow for a claim. Cross-border and commercial vehicles raise the question of which insurance applies and whether a federally regulated carrier is involved, which changes both the available coverage and the records that must be preserved. And the CHP San Diego Area office covers a very large freeway network, so a report can take longer to obtain than on city streets — a reason to request it early rather than after treatment ends.

What being out of town does and does not change
It does not change the investigation. Collision reports, medical records, camera footage, insurance policies and expert work are obtained the same way from anywhere in the state, and every insurer in California handles claims by phone and mail regardless of where the lawyer sits. It does not change the fee: nothing upfront, and no fee unless we win.
What it changes is convenience. You will meet us by phone and video rather than in a lobby, and if you would rather sit across a desk from your lawyer every few weeks, a firm with an office in your own city may suit you better. We would rather say that plainly at the start than have you find it out later.
How the work actually happens
We request the collision report from the responding agency, canvass for footage before it is overwritten, preserve physical evidence, identify every applicable policy, and document your injuries through your own treating physicians. If you would rather have a lawyer with an office in your own city, that is a reasonable preference and we will tell you so plainly.
Where would my case be heard if I live in San Diego?
In the Central Division of the San Diego County Superior Court. Unlimited civil cases from across the county are handled there: filings at 330 W Broadway, with the Central Courthouse at 1100 Union St hearing unlimited civil matters. The court asks filers to identify the city or zip code where the defendant lives or does business, or where the incident occurred, so a San Diego collision is a Central Division case either way.
Who takes the crash report in San Diego?
On city streets, San Diego Police Department; collision reports are released online through eCrash, by mail to SDPD Records, or in person at the Records Division, 1401 Broadway, and release is limited to people with a proper interest under Vehicle Code § 20012. On the freeways, CHP San Diego Area, 5902 Kearny Villa Rd, San Diego, which states it covers fourteen freeway systems and over three hundred miles, serving San Diego, Chula Vista, National City and Coronado. Knowing which agency responded tells you where to request the report, and we can request it for you.
Does it matter that none of your lawyers sit in San Diego?
For the work that decides a case, rarely. Reports, medical records, evidence and negotiations with insurers are handled the same way remotely. Where physical presence does matter — depositions, mediations and hearings — we travel; you do not.
How long do I have to bring a claim?
Generally two years from the injury under Code of Civil Procedure section 335.1. If a city, county, transit agency or the state is responsible, a written claim is generally due within six months under Government Code section 911.2. That shorter deadline is the one most often missed.
